By using 4ga ("4ga", "our", "us" or "we") products, services, software, tools, addons, games, simulations, apps and websites collectively referred hereinafter as "4ga Products", you agree to be bound by the following terms and conditions ("Terms of Service", "Terms").
The Terms are current as of their last revision date. We reserve the right to change the Terms at any time. If material changes are made, the revised Terms will be posted with the modification date at the top of the page. Please review the Terms periodically to stay informed of any changes. Your continued use of 4ga Products after such changes constitutes your acceptance of them. If you do not accept any changes, you may choose not to use 4ga Products or opt out by sending us an appropriate notice.

We may withdraw or amend 4ga Products, and any related service or content, or restrict access (including by means of cancellation, termination, modification, or suspension of a user account) to all or certain users (including you) without notice and without liability to you. Additionally, due to your geographic location, 4ga Products or some of their features, or content may be unavailable to you.
To access certain 4ga Products, you will be asked to provide registration details or other information, and in order to use such resources, all the information you provide must be correct, current, and complete. From time to time, in order to access 4ga Products or use some of the functionalities, 4ga may require some or all users to download updated or additional software. The terms of use of such software may be subject to separate agreement between you and 4ga.
If you choose, or are provided with a username, password, or any other piece of information as part of our security procedures, you must treat such information as confidential (other than the username), and you must not disclose it to others. You must immediately notify 4ga using the contact form of any unauthorized use of your username or password or any other breach of security. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information. You may only access 4ga Products through your own account. Users do not own their accounts, and gifting or otherwise transferring of accounts or access keys is prohibited.
4ga may terminate or suspend your account, access to services, or any part of 4ga Products at any time, with or without notice, for any or no reason, including without limitation, violation of these Terms, non-payment, engagement in fraudulent activities, or abusing services (e.g. excessive storage). You may terminate your account at any time by contacting us. Upon termination, you may lose access to any purchased content, including 4ga Products or in-product items, and no refunds will be provided for unused account balance or services. Upon termination, you must immediately cease all use of 4ga Products.
4ga Products, including all content, logos, trademarks, code, and other proprietary information, are owned by 4ga, or other providers of such material and are protected by United States and international copyright, trademark, patent, and other intellectual property or proprietary rights laws. All trademarks are property of their respective owners.
You must not reproduce, sell, or exploit for any commercial purposes any part of 4ga Products, access to 4ga Products or use of 4ga Products, including any functionalities or materials available through 4ga Products (except as permitted by applicable licenses). You may create content inspired by 4ga Products (e.g. fan arts), tools, software, and addons for 4ga Products, including for commercial purposes, provided it does not compete with or harm 4ga's business interests.
If you wish to use anything that belongs to us in a commercial manner, you must obtain our consent. For clarity, the foregoing permissions are limited to 4ga Products and no rights are granted with respect to any servers, computers, or databases associated with 4ga Products.
In accordance with the applicable law, we have adopted a policy of terminating users or account holders who are considered to be multiple infringers of the copyrights of others. 4ga may also limit access to 4ga Products and/or update, or delete the accounts of any users who infringe the intellectual property rights of others. Each case will be executed separately in appropriate circumstances determined by 4ga. If you believe that your work has been used in 4ga Products please contact us.
You may use 4ga Products only for lawful purposes and in accordance with these Terms. You agree not to access or use 4ga Products for any purpose that is illegal or beyond the scope of their intended use (in 4ga's sole judgment).
4ga Products contain various forums, chats, posts, networks, and other interactive features that allow you to post, submit, publish, display, or transmit content or materials (collectively referred hereinafter as "User Generated Content") to 4ga and other users on or through 4ga Products.
When you submit any User Generated Content, you grant 4ga a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute that content in connection with its services. You retain ownership of your content but acknowledge that 4ga is not responsible for any User Generated Content and reserves the right to monitor, modify, and remove it at its discretion.
All User Generated Content must comply with the following content standards: User Generated Content must not be illegal, fraudulent, deceptive, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable, and must not consist of or contain software viruses, commercial solicitation, chain letters, mass mailings, or any form of "spam".
You may link to components of 4ga Products if you do so in a way that is fair and does not damage or take advantage of our reputation. However, you must not establish a link in such a way as to suggest any form of association, approval, or endorsement on our part. 4ga Products must not be framed on any other website or service. We reserve the right to withdraw linking permission without notice.
If 4ga Products contain links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the content of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.
Although we are responsible for the advertisements placed in 4ga Products, we do not control their content except the general type. We ensure that 4ga Products do not contain any inappropriate advertisements. Please report any advert that you find offensive or inappropriate using the contact form. If you click on any advert you will be taken to external sites for which we are not responsible.
4ga Products, including all materials, information, messages, online communications from 4ga, and other content included on or otherwise made available to you through 4ga Products or 4ga servers (collectively referred hereinafter as "4ga Products and Content"), are provided by 4ga on an "as is" and "as available" basis. 4ga makes no representations or warranties of any kind, express or implied, as to the operation of 4ga Products and Content. You expressly agree that your use of 4ga Products and Content is at your sole risk. To the fullest extent permissible by law, 4ga disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. 4ga does not warrant that 4ga Products and Content are free of viruses or other harmful components.
To the fullest extent permissible by law, 4ga will not be liable for any loss of profits, or any indirect, incidental, punitive, special, or consequential damages arising out of or in connection with this Agreement. Further, to the fullest extent permissible by law, 4ga's aggregate liability arising out of or in connection with this Agreement will not exceed the total amounts you have paid (if any) to 4ga under this Agreement during the twelve (12) months immediately preceding the events giving rise to such liability.
4ga reserves the right to modify, suspend, or discontinue any part of 4ga Products, including features, availability, and pricing, at any time without prior notice. In case of significant changes to the core functionality or availability of 4ga Products, users will be notified. If you do not agree to any changes, you may choose to discontinue using the affected service. 4ga will not be liable for any impact such changes may have on your experience.
To the fullest extent permitted by law, the controlling language for these Terms is English.
These Terms shall be governed by and construed in accordance with the laws local to the headquarters of 4ga. Any disputes, claims, or controversies arising out of or in connection with these Terms shall first be attempted to resolve through informal negotiation. If a resolution cannot be reached through negotiation, disputes shall be settled through arbitration.
4ga shall not be liable for any failure or delay in the performance of its obligations under these Terms due to causes beyond its reasonable control, including but not limited to natural disasters, fire, flood, war, terrorism, labor strikes, pandemics, government restrictions, or technical failures. In such cases, 4ga's performance shall be deemed suspended for the duration of the Force Majeure event. If the event extends beyond a reasonable period, 4ga may, at its discretion, terminate or modify the services offered.
You agree to defend, indemnify, and hold harmless 4ga, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or fees resulting from your User Generated Content or violation of these Terms.
No waiver of these Terms by 4ga shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure of 4ga to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be eliminated or limited, and the remaining provisions shall continue in full force and effect.
Any promotional code provided to you by 4ga for use as a Payment Method may be subject to additional terms and conditions associated with the promotion, offer, or coupon. When you provide a Payment Method to 4ga for use in connection with the 4ga Account Balance, you represent to 4ga that you are the authorized user of the Payment Method, and you authorize 4ga to charge your Payment Method to top up your 4ga Account Balance or collect other fees incurred by you. If your use of the 4ga Account Balance is subject to any sales or other taxes, then 4ga may also charge you for those taxes. You are responsible for all uses of your 4ga Account Balance, including all applicable taxes and all purchases.
The 4ga Account Balance has no value outside 4ga Products. If you are refunded for an item purchased using the 4ga Account Balance, 4ga may return the funds to your 4ga Account. The 4ga Account Balance is non-transferable to another person and does not accrue interest.
We reserve the right to suspend or terminate your 4ga Account Balance if we consider your Account conduct fraudulent or involving other illegal, activity in this case your 4ga Account Balance is not refundable.
Online orders may be processed with realtime credit card transactions or other payment methods. Any payment-related issues should be addressed with the payment provider, as we do not handle payments directly.
You can request a refund for nearly any purchase on 4ga - for any reason.
Upon receiving your request via the contact form, 4ga will review your case and determine whether you are eligible to get a refund.
The refund will be issued through the same payment method you used to make the purchase. If, for any reason, 4ga is unable to issue a refund via your initial payment method, we will contact you to arrange an alternative method. (Some payment methods available in your country may not support refunding a purchase.)
Refunds are designed to remove the risk from purchasing 4ga Products and in-product items - not as a way to get free virtual goods. If it appears to us that you are abusing refunds, we may stop offering them to you.

There is no guarantee that the refund process will be completed successfully if you are caught violating the Terms or exploiting 4ga Products (e.g. hacking our products, or cheating in our games).
Additional refund terms for 4ga Products or in-product items bought on external platforms might be provided on a respective platform site.

All 4ga Products and in-product items are virtual and have no value. You are granted a non-transferable, non-exclusive license to use 4ga Products and in-product items without the ownership rights. 4ga Products and in-product items cannot be exchanged, sold, or transferred to other users. 4ga may modify or discontinue the availability of 4ga Products and in-product items at any time, and no refunds will be provided for virtual goods once purchased, except as specified in the Refund Policy. If 4ga Product is no longer supported (following an announcement and a shutdown period), we do not accept refunds and provide in-product services.
